If Gift Paradise terminates user(s) membership, user(s) will not have the right to re-enroll or join Gift Paradise under a new account or name unless formally invited to do so by Gift Paradise.. IX. CANCELLATION 

Gift Paradise reserves the universal right to cancel a customer order at any time for any reason, with or without notice. Gift Paradise will however, refund the amount paid by the customer and realized by Gift Paradise in full.

As per the Gift Paradise policy, all refunds to the customers are done using the customer’s Store Credit account. The refunded money in the Store Credit account can be used by the customer to purchase any other product from Gift Paradise within 15 days of refund.

In case the customer insists on a refund that requires transaction reversal in the customer’s Credit Card or Debit Card account, Gift Paradise will charge the customer 15% of the refund amount.

X. SHIPPING LIMITATIONS 
When an order is placed, it will be shipped to an address designated by the purchaser as long as that shipping address is compliant with the shipping restrictions contained on this Web Site. Any purchases from this Web Site made through a shipment contract, risk of loss and title for items purchased from this Web Site pass to you upon delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.

XI. PRICING DEFINITIONS 
Gift Paradise product pricing is primarily administered by the pricing policies of the distributors and manufacturers of Gift Paradise as per mutually agreed and signed contracts. The product pricing displayed to the visitors have the following meanings and definitions:

 (b) Website Price: The Website Price indicates the approximate average of the product available on the website. Gift Paradise conducts regular surveys to compute the average price of a product as per the available statistics. The Website Price does NOT represent the maximum retail price of a product and can be greater or lesser than the actual maximum retail price.

XII. REFUNDS & CHARGEBACKS 
Gift Paradise ensures the accuracy of pricing, product information and stock availability displayed on the site. In spite of this, Gift Paradise may not be able to fulfill all orders due reasons beyond our control. Some of the reasons could be:

(a) Product Recall: The manufacturers may recall products from the market, without notice, from time to time due to safety and bad product design reasons.
(b) Out of Stock: The product may have been sold out from the Gift Paradise inventory and may also not be available in the open market for instant procurement and fulfillment.
Under such circumstances, Gift Paradise may be forced to enter a back order and the delivery might be delayed up to 5 additional business days than the regular period specified in the shipping and delivery. 

As per the Gift Paradise policy, all refunds to the customers are done using the customer’s Store Credit account. The refunded money in the Store Credit account can be used by the customer to purchase any other product from Gift Paradise within 15 days of refund.

XIX. GOVERNING LAW AND DISPUTE RESOLUTIONS
Terms and condition of use agreement and/ or Agreement, supersede any other agreement between you and Gift Paradise to the extent necessary to resolve any inconsistency or ambiguity between them. These terms and Conditions shall be governed by and construed in accordance with in all respect by the law of Ontario, Canada. Gift Paradise considers itself and intended to be subject to the jurisdiction only of Ontario Canada. The parties to this Agreement hereby submit to the exclusive jurisdiction Ontario, Canada.

THE USER OF GIFT PARADISE WEBSITE IS PRESUMED TO BE ABOVE THE AGE OF 16 YEARS AND TO HAVE READ ALL THE TERMS AND CONDITIONS HEREIN AND IS DEEMED TO HAVE AGREED, UNDERSTOOD AND ACCEPTED UNCONDITIONALLY ALL THE TERMS, CONDITIONS, PROCEDURES AND RISKS OF USING THE SERVICES AND CAN NOT AT ANY TIME CLAIM IGNORANCE OF ANY OR ALL OF THEM. ALL RELATIONSHIP OF ANY USER WHERESOEVER SITUATED IS GOVERNED BY AND IN ACCORDANCE WITH THE LAWS AND JURISDICTION OF ONTARIO, CANADA.
